Terms of Use

01Who we are, and what this covers

Goat Deeper (the “Application”) is published and operated by STORIA, a French société par actions simplifiée with a share capital of €1,000, registered with the Trade and Companies Register of Bastia under number 977 968 270, whose registered office is at 20 Lot Tombulu Biancu, 20620 Biguglia, France (“STORIA”, “we”, “us”).

These Terms of Use (the “Terms”) form a binding agreement between you and STORIA. By downloading, launching or playing the Application, you accept them. If you do not accept them, do not use the Application.

How we handle your data is described separately, in our Privacy Policy, which forms part of this agreement.

02Eligibility and age

The Application generates mature fantasy themes — violence, peril, dark humour. It is not intended for children under 13, and you must be at least 13 to play.

If you are a minor, you may only use the Application with the agreement of the person who holds parental responsibility for you, who accepts these Terms on your behalf and is responsible for any purchase you make.

03Your licence to play

We grant you a personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the Application on a device you own or control, for your own private entertainment, for as long as these Terms are in force.

That is all the licence grants. We sell you no copy of the Application, and we transfer you no intellectual property right in it. Any use not expressly permitted here is reserved.

04Your player profile

The Application does not ask you to create an account. It signs you in anonymously and attaches your saves, your gems and your purchases to a random identifier held on our servers.

Your profile is personal. You may not sell, rent, lend or transfer it, and you may not try to access someone else's.

05How the game works: AI-generated content

There is no pre-written story in Goat Deeper. Scenes, dialogue, characters and images are generated as you play, by large language models operated by our providers, from the text you type. Read our Privacy Policy for exactly what is sent to whom.

Three consequences follow, and you accept them by playing:

• Output is unpredictable. It may be inconsistent, factually wrong, or occasionally distasteful, despite the filters we apply. It is fiction. It is not advice of any kind, and it does not express the views of STORIA.
• Output is not unique. Another player writing something similar may receive something similar. We promise you no exclusivity over what the game generates for you.
• Output may not be protectable. In many countries, material generated by a machine without sufficient human creative input attracts no copyright. We make no representation that you own, or can enforce rights in, what the Application generates.

You are responsible for the text you submit, including any attempt to steer the game towards content that these Terms prohibit.

06Content you create

The original content you create in the Application — the names, descriptions and backgrounds you write for your characters, the text of your actions — remains yours, to the extent it is protectable at all. We claim no ownership of it.

To be able to operate the Application at all, we need your permission to handle that content. You therefore grant STORIA a worldwide, royalty-free, non-exclusive licence to host, store, copy, transmit, translate, reformat and display your content, and to send it to the AI providers named in our Privacy Policy, in each case solely for the following purposes:

• running the Application and generating your adventure;
• displaying your content back to you, and to other players if — and only if — you choose to publish it (section 7);
• content moderation, security and fraud prevention;
• debugging, technical diagnosis and improving the Application.

This licence lasts as long as we host your content, and ends when your content is deleted, except for copies retained in backups or as the law requires. We do not use your content to train AI models, we do not licence it to anyone for their own purposes, and we do not sell it.

07Content you publish

You may choose to publish a custom character to the in-app gallery. If you do, its name, description and generated images become visible to other players, who may like it, and the images are served from a public web address that anyone with the link can open.

By publishing, you confirm that the content is yours to publish, that it infringes nobody's rights, and that it complies with section 8. You may unpublish it at any time, though copies other players have already seen or saved are beyond our reach.

08Rules of conduct

You agree not to use the Application to create, submit or publish content that:

• is unlawful, or promotes an unlawful act;
• sexualises minors, or depicts sexual content of any kind;
• incites hatred, violence or discrimination against real people or groups, or harasses anyone;
• impersonates a real, identifiable person, living or dead, or a public figure;
• infringes anyone's intellectual property, or reproduces protected characters or settings that are not yours;
• contains personal data about you or about anyone else.

And you agree not to:

• reverse-engineer, decompile or disassemble the Application, except to the extent French law expressly permits it for interoperability, and then only after asking us first;
• tamper with the game to obtain gems, items or progress you have not earned or paid for;
• access the Application through an automated system, scrape it, or place unreasonable load on our servers;
• attempt to extract, reconstruct or circumvent our prompts, our AI configuration, or our safety filters — including by prompt injection;
• use the Application, or anything it generates for you, to train a machine-learning model, to build a dataset, or to develop or operate a service that competes with Goat Deeper;
• resell, commercially exploit or redistribute the content the Application generates.

09Moderation, suspension and termination

We screen custom characters automatically before they are created, and we may review content that is reported to us. We may remove content that breaches section 8, and suspend or terminate access for a player who breaches these Terms.

Except where the breach is serious or repeated, or where the law requires immediate action, we will tell you why and give you a chance to respond. You may contest any decision at contact@goat-deeper.app.

If we terminate your access because you breached these Terms, unspent gems are forfeited and no refund is due. If we terminate it for any other reason, or if we withdraw the Application, we will refund the portion of your purchases corresponding to unspent gems you bought, and to the unused part of any subscription period.

You may stop at any time by deleting the Application. To have your data erased as well, see our Privacy Policy.

10Gems, purchases and subscriptions

Gems

Gems are the in-game currency spent to advance your adventure. They have no monetary value, are not your property, cannot be exchanged for money or transferred to another player, and constitute a limited licence to use a feature of the Application. There are three kinds, and they behave differently:

Purchases and subscriptions

• All purchases are made through Apple's App Store. Prices are the ones displayed at the moment of purchase, taxes included.
• A subscription renews automatically at the end of each period, and Apple charges you, unless you cancel at least 24 hours before the end of the current period. Cancel in your Apple Account settings. Deleting the Application does not cancel a subscription.
• If we change a subscription price, Apple will notify you and ask you to consent before the new price applies. You are free to cancel instead.
• Refunds are handled by Apple, under the Apple Media Services Terms and Conditions. We cannot process them ourselves. This does not affect your statutory rights against us.
• Restoring purchases restores your subscription status and any gems you bought that remain unspent.

11Right of withdrawal

As a consumer in the European Union, you normally have 14 days to withdraw from a distance contract without giving a reason.

Digital content that is supplied immediately is an exception. When you buy gems or start a subscription, you expressly ask for the content to be made available to you at once, and you acknowledge that you thereby lose your right of withdrawal once performance has begun, in accordance with article L221-28, 13° of the French Consumer Code. You confirm this at the moment of purchase.

Your statutory guarantee of conformity — articles L217-1 and following of the French Consumer Code — is unaffected, and you keep it in full.

12Referral programme

The Application may let you share a personal referral code. When a new player uses it, both of you receive gems, subject to the conditions displayed in the Application at the time, including a maximum number of players you may refer.

A code may be redeemed once, by a genuinely new player, and only before that player has begun their adventure. Referring yourself, creating profiles for the purpose of collecting rewards, or otherwise gaming the programme, causes the rewards to be forfeited and may lead to termination under section 9. We may change or end the programme at any time, without affecting gems you have already received.

13Our intellectual property

The Application and everything in it that is not your content — the software and its source code, the game systems, the illustrations, the companions and their portraits, the music and sound, the interface, the texts we wrote, the world of Aethelgard and its places and characters, the prompts and the AI configuration behind the game, the name Goat Deeper and the logo — belong to STORIA or to its licensors, and are protected by copyright, trade mark law, and the law protecting databases.

Nothing in these Terms transfers any of it to you. You may not copy, adapt, distribute, publicly communicate or create derivative works from it, beyond what your licence in section 3 permits and beyond the exceptions the law grants you.

If you believe content in the Application infringes your rights, write to contact@goat-deeper.app with enough detail to identify the content and your right, and we will act promptly.

14Availability, updates and end of service

Goat Deeper is an online service: it needs our servers and our AI providers to generate anything. We work to keep it available, but we do not promise uninterrupted access. It may be unavailable during maintenance, updates, incidents at our providers, or events beyond our control.

We may change, add or remove features, and we may require you to install an update to keep playing. We will not remove a feature you paid for without offering you a fair remedy.

If we ever decide to discontinue the Application, we will announce it in the Application at least 30 days in advance, stop selling gems and subscriptions immediately, and refund unspent purchased gems and the unused part of any subscription, as set out in section 9.

15Warranties

Beyond the guarantees the law gives you, the Application is provided “as is”, and we make no promise that it will meet your expectations, be free of errors, or generate content you find satisfying.

Nothing in this section limits the statutory guarantee of conformity (articles L217-1 and following of the French Consumer Code) or the guarantee against hidden defects (articles 1641 and following of the French Civil Code), which apply in full and are free of charge.

16Liability

We are liable to you for the foreseeable loss that a failure to meet our obligations under these Terms directly causes you. We are not liable for loss that was not foreseeable, for loss caused by your own breach of these Terms, or for loss arising from a service operated by someone else.

To the extent French law permits, our total liability towards you, for all events occurring in any twelve-month period, is limited to the greater of the amount you paid us during that period and fifty euros (€50).

17Apple

You obtained the Application from Apple's App Store. The following applies to that relationship:

• These Terms are concluded between you and STORIA alone. Apple is not a party to them.
• STORIA, not Apple, is solely responsible for the Application and its content.
• Apple has no obligation whatsoever to furnish any maintenance or support for the Application.
• If the Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claim, loss, liability, damage, cost or expense attributable to a failure to conform to a warranty is STORIA's responsibility.
• STORIA, not Apple, is responsible for addressing any claim by you or a third party relating to the Application, including product liability claims, claims that the Application fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation, as well as any claim that the Application infringes a third party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms, including the Apple Media Services Terms and Conditions.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right — and is deemed to have accepted the right — to enforce them against you.

18Third-party services

The Application links to services we do not operate, including our Discord community. When you leave the Application you leave these Terms behind: what happens on Discord is governed by Discord's own terms and community guidelines, and by the rules of our server. We are not responsible for those services, and we do not endorse their content.

19Changes to these Terms

We may update these Terms — to reflect a change in the game, in our providers, or in the law. The date at the top tells you which version is in force.

We will announce any material change inside the Application, at least 7 days before it takes effect. We cannot email you, because we do not have your email address. If you keep playing after that, you accept the new Terms. If you do not accept them, stop playing and, where the change disadvantages you and you had a subscription, write to us and we will refund its unused part.

20Governing law and disputes

These Terms are governed by French law. If you are a consumer resident in the European Union, this choice does not deprive you of the protection of the mandatory rules of the country in which you live.

Talk to us first: most problems are solved in one email to contact@goat-deeper.app.

If that fails, and you are a consumer, you may refer the dispute free of charge to a consumer mediator. Write to contact@goat-deeper.app and we will provide the contact details of the mediation service competent for your request, at no cost to you.

Failing an amicable settlement, the dispute may be brought before the competent courts. If you are a consumer, you may sue us, and may only be sued, in the courts of the EU Member State where you are domiciled, in accordance with Regulation (EU) No 1215/2012. If you are not a consumer, the courts of Paris, France have exclusive jurisdiction.

21Miscellaneous

• Force majeure. Neither party is liable for a failure caused by an event beyond its reasonable control, within the meaning of article 1218 of the French Civil Code.
• Severability. If a court finds a provision unenforceable, the rest of these Terms continues to apply.
• No waiver. If we do not enforce a right immediately, we do not lose it.
• Assignment. You may not assign these Terms. We may assign them to a company that acquires our business, provided your rights are not reduced.
• Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Application.
• Language. These Terms are published in English and in French. In the event of a discrepancy, and where you are a consumer resident in France, the French version prevails.
